It’s a State of Emergency; I Can't Make It To Work

Do you have to report to work if a State of Emergency is declared?  Yes.  No law in New Jersey requires a private employer to close or release employees from work due to a state of emergency being declared.  A Bill currently pending before the New Jersey Legislature is trying to change the law, but has not made it very far to date.  Assemblyman Benjie E. Winterly sponsored A1129 to prohibit employers from taking any adverse actions against an employee who is unable to work or perform services at the employer’s place of business due to a declared State of Emergency.  The Bill excludes certain necessary personnel (medical, public safety, and others).  Prior Bills on this issue were introduced in 2014 and 2016, but they both died.  Keep an eye on this Bill, but in the meantime, get to work!
