This webinar will dive into the legal issues around the COVID-19 vaccine and other legal matters arising from the pandemic. With COVID-19 vaccine delivery increasing, so are the legal questions that companies throughout the food processing industry face. New questions have come to the forefront of navigating the pandemic, including:
- How should employers approach employee vaccinations? Mandatory, strongly encourage, or another approach?
- What is your legal exposure if hosting a vaccination clinic?
- What laws do we need to comply with in crafting a vaccine program?
- What is the impact on mask-wearing and social distancing with increased vaccination rates?

About Your Presenting Attorneys
Pat, Chair of the firm’s Labor & Employment Practice Group, practices labor, employment, and personnel law on behalf of employers and management personnel. He has a wide range of experience in all areas of litigation in both federal and state courts, defending discrimination and sexual harassment claims, wrongful discharge and whistleblower suits, and claims brought under the Americans With Disabilities Act, the Family and Medical Leave Act, and the multitude of other civil rights and anti-discrimination laws. In addition, Pat represents parties in breach of contract claims and in actions involving unfair competition, restrictive covenants, and confidentiality agreements.
Pat has appeared before state human rights agencies throughout the country, as well as the EEOC, the National Labor Relations Board, and various wage and hour agencies. He has represented employers in numerous labor grievance/arbitration proceedings and in a variety of other matters relating to the unionization of employees and collective bargaining. Pat has also worked extensively with employers on public works contracts to ensure compliance with prevailing wage laws.
A great deal of Pat’s practice concentrates on counseling employers in making workplace decisions, which will reduce or avoid entirely the risk of litigation. He regularly counsels his clients on matters concerning independent contractors and contingent workers, employment policies, employee discipline and terminations, reductions in workforce, and plant closings. Pat has conducted sexual harassment investigations and employment law audits, and has drafted numerous employee handbooks and substance abuse and workplace privacy policies. He has also conducted management and employee training and legal compliance sessions in a variety of areas, including the performance appraisal process and anti-harassment.
Danielle, Co-Chair of the firm’s Intellectual Property Law Practice Group, focuses her practice on intellectual property matters and litigation. She appears on behalf of individual and corporate clients in all phases of litigation from commencement through trial. Danielle regularly serves as lead counsel in cases before federal and state courts, the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, and alternative resolution forums.
Danielle has represented clients in a variety of industries, most notably, food and beverage, liquor, jewelry, cosmetics, sports, and entertainment. Her focus is on trademark prosecution and litigation. She has represented clients in cases involving trademark and copyright infringement, false advertising, commercial disparagement, business torts, deceptive trade practices, Lanham Act claims, state and federal unfair competition laws, and other business disputes.
Danielle is involved in several organizations including the IP Section of the New York State Bar Association and the International Trademark Association (INTA), serving on the Trademark Offices Practice Committee. She is also a regular contributor to Norris McLaughlin’s trademark, copyright, and unfair competition law blog, More Than Your Mark.
Dan, Co-Chair of the firm’s Litigation Practice Group, represents clients in commercial litigation and “outside” general counsel assistance with a specialty in manufacturing and distribution, business disputes, medical device companies, construction, professional liability, franchise law, arbitrations and mediations, and international matters.
Dan has been counsel to Lloyd’s of London in professional liability defense matters, Swiss conglomerate ABB, French power company Alstom, National Starch and Chemical Company, the Housing Authority of the City of Newark, the City of Perth Amboy, MFS Engineers and is the main U.S. outside counsel for Swiss medical equipment manufacturer, Schiller A.G. He was a member of the legal team representing Finnish medical equipment manufacturer Datex-Ohmeda in North America and Latin America. Dan is outside counsel for one of the largest Hispanic-owned food manufacturing businesses in the U.S., Tropical Cheese Industries, as well as ice cream manufacturer Delicioso Coco Helado. He defended car maker John Z. DeLorean in a federal action in New Jersey.
Dan also represents hotel and restaurant franchisees in litigation and disputes. He has handled and supervised litigation and transactional matters in Switzerland, Spain, Mexico, El Salvador, Colombia, Peru, Bolivia, Paraguay, Costa Rica, and Puerto Rico. He is regarded as a trusted, reliable advisor to many business owners and companies. Dan is on the exclusive roster of arbitrators of the American Arbitration Association. He served as an International Chamber of Commerce Arbitrator and Adjunct Seton Hall Law School Professor.
Annmarie, Co-Chair of the firm’s Diversity Committee, concentrates her practice on labor and employment counseling and litigation. She has a wide range of experience in state and federal courts, as well as in alternative dispute resolution venues, primarily defending management in claims made by employees under state and federal employment laws, including whistleblower claims, as well as claims alleging harassment and discrimination based on race, gender, religion, national origin, and disability.
Annmarie’s work includes the defense of corporate defendants, as well as individual officers, directors, and employees, addressing issues unique to small businesses, as well as challenges faced by larger companies. Additionally, Annmarie provides advice and counseling to human resource professionals and in-house counsel with respect to a wide range of employment issues, including employee leaves of absence, employee discipline, employee manuals, employment-related policies and procedures, and layoff and termination issues, including the negotiation and design of severance agreements.
Annmarie has significant experience protecting businesses from liability by conducting training for supervisors and employees. She has presented programs on handling workplace investigations; on acceptable workplace behavior which includes issues of harassment, bullying, and other workplace conduct rules; and on how to properly craft and implement employee handbooks. Annmarie also has significant experience in complex commercial litigation, focusing on business disputes such as shareholder actions, commission disputes, and breach of contract matters.
