About the Presentation
The presentation will cover recent regulatory and judicial developments, Affordable Care Act (ACA) requirements, and best practices for ERISA compliance. Included will be an overview of the district court ruling and the Department of Labor’s (DOL) response, other options for association plans, MEWA regulations and other state challenges, and best practices for Association Health Plans (AHPs) to ensure compliance with federal and state law. Presenters will also identify areas of concern following the district court’s ruling on the DOL final regulations for AHPs, determine “commonality of interest” in qualifying as bona fide association under the DOL’s prior guidance, review understanding ACA requirements and exemptions applicable to small employers and AHPs, recognize state law challenges and MEWA regulations impacting AHPs, and establish the applicability of new provisions to current plans and best practices to ensure compliance.
