    Timothy S. Klimpl, an Associate of law firm Norris McLaughlin, P.A., has been included in the New York Metro Rising Stars® 2019 Edition in the Employee Benefits category.  Only two and a half percent of New York attorneys are given this honor, which recognizes lawyers age 40 and under or who have been practicing for fewer than 10 years.

    “It is a fantastic honor to be awarded this distinction among my talented peers throughout the New York metro area,” stated Klimpl.

    New York Metro Rising Stars, a listing of outstanding lawyers from more than 70 practice areas who have attained a high degree of peer recognition and professional achievement, is published in Super Lawyers Magazine.  The rigorous selection process combines peer nominations and evaluations with third-party validation of professional accomplishments.  The magazine, which features the list and profiles of selected attorneys, is distributed to attorneys in the state or region and to ABA-accredited law school libraries.  Super Lawyers is also published as a special section in leading city and regional magazines across the country.  In the United States, Super Lawyers Magazine is published in all 50 states and Washington, D.C., reaching more than 13 million readers.

    Klimpl has represented a broad array of plan sponsors and employee benefit plans, including corporate, nonprofit, multi-employer and governmental plans providing retirement, health, disability, dental and other welfare benefits.  He advises clients in a range of issues including ERISA compliance, the Pension Protection Act, the Affordable Care Act (ACA), U.S. Department of Labor investigations, COBRA, HIPAA, benefits due diligence in corporate transactions, tax qualification requirements under the Internal Revenue Code for employee benefit plans,  and the IRS Voluntary Correction Program (VCP) for retirement plans under the Employee Plans Compliance Resolution System (EPCRS).

    Klimpl has reviewed and interpreted collective bargaining agreements (CBAs) and drafted CBA language relating to employer funding obligations under the Pension Protection Act and tax provisions under the ACA. He also prepares employee handbooks and advises employers regarding wage and hour laws, anti-discrimination statutes, and employment agreements; engages in corporate formation; and applies for and obtains federal tax-exempt status for non-profit organizations.Klimpl represents senior-level employees in the negotiation of their employment and severance packages and all associated agreements, including evaluation of wrongful termination claims.  His work for clients includes employment and post-employment compensation, health coverage and COBRA issues, confidentiality, non-compete, non-solicitation, and benefits and protections within the structures and strategies for those packages.

    Klimpl received his J.D. from New York Law School and his B.A., cum laude, from Syracuse University.

    Rashmee Rayna Sinha, a Member of law firm Norris McLaughlin, P.A., has been included in the New Jersey Rising Stars® 2019 Edition in the Employment Litigation: Defense category for the fourth consecutive year.  Only five percent of New Jersey attorneys are given this honor.

    As a logical, strategic, and pro-active employment defense attorney, Sinha has a proven track record of extricating clients from suit in the early stages of litigation. She primarily handles claims under Employment Practices Liability Insurance, Directors and Officers and Errors and Omissions polices related to discrimination, harassment, retaliation, failure to accommodate, whistle-blower, and wrongful discharge on the basis of protected categories (i.e. age, sex, disability, race, gender, national origin, religion, pregnancy etc.).

    Sinha represents employers from industries including healthcare, construction, financial services, property management, insurance, technology, transportation, building services, hotel and hospitality, retail, manufacturing, power and energy, and pharmaceutical.

    Sinha is experienced in all areas of employment litigation in both federal and state courts. She has defended administrative proceedings and regulatory compliance investigations before numerous employment practice agencies including the EEOC, and the federal and state Department of Labor and the Department of Health. Sinha counsels employers on employment and compliance issues including employment policies, contracts, discipline, terminations, leaves of absence, accommodations, complaints, investigations, benefits, proprietary information, restrictive covenants, reorganizations, and executive compensation.

    Sinha earned her J.D. from Seton Hall University School of Law, and her B.A. from Boston University. She is a member of the Labor of Employment Section of the American Bar Association and the New Jersey State Bar Association.
