COVID-19-Related Litigation Explodes Leading into May and June 2020
As a follow-up to our April 23, 2020, blog post, “Be Prepared for an Onslaught of Coronavirus-Related Lawsuits,” we are sharing the “COVID-19 Impact Analyzer” report from Lex Machina® on general and COVID-19-related case filing statistics for covered jurisdictions and courts with the permission of Lex Machina®.
About the Lex Machina® COVID-19 Impact Analyzer Report
The report compares certain case filings for followed courts for the last weeks of May 2018, 2019, and 2020. Note the big jump in general product liability case filings for the last week of May 2020. Perhaps, most importantly, note the increasing number of COVID-19-related case filings (by criteria established by Lex Machina®) from the period beginning February 24, 2020, and ending May 31, 2020. Although the high filing rate during the month of May 2020 seemed to level off, it increased dramatically during the months of March through early May to a significant weekly rate. It will be interesting to see the trend over the summer as businesses and states ease on closures and restrictions.
